1. Introduction

Welcome to Wild Fantasy Writers ("the Platform"), an online service operated by Josue A. Burkhan. Wild Fantasy Writers provides tools for authors to create and manage fictional worlds ("User-Generated Content") and offers subscription-based access for readers. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms").

2. Services and Subscription Plans

Wild Fantasy Writers provides the following subscription plans:

  • Free Plan: Create 1 world, up to 80 characters, 50 items or abilities, and upload up to 5 character images.
  • Premium Plan: Create up to 3 worlds, 505 characters, 300 items or abilities, publish a public wiki, use AI for 10 monthly image generations, generate 1 map per world, and access upcoming emblem/shield generation features.
  • Creator of Worlds Plan: Unlimited worlds, characters, items, and abilities, 60 monthly AI image generations, public wiki, up to 5 maps per world, and unlimited emblem/shield generation once available.

The features and limits of each plan are subject to change. We will provide notice of any significant changes to active subscribers.

3. User Accounts

To access most features of Wild Fantasy Writers, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Payments and Renewals

All payments for subscription plans are securely processed through our designated payment processor (e.g., PayPal). Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless canceled by you before the renewal date. By subscribing, you authorize recurring charges to your payment method.

5. Refund Policy

Refunds are issued at our sole discretion and are generally limited to cases of fraud, significant technical errors on our part, or duplicate charges. Dissatisfaction with the service does not automatically qualify for a refund. Our complete Refund Policy provides full details.

6. Intellectual Property

You, the author, retain full ownership of the copyright and all intellectual property rights to your User-Generated Content. By uploading or creating content on the Platform, you grant Wild Fantasy Writers a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform. This license terminates when you remove your content from the Platform.

7. User Conduct & Prohibited Content

You agree not to post content that is illegal, defamatory, harassing, hateful, infringing on intellectual property rights, or otherwise objectionable. You are solely responsible for your conduct and your content. We reserve the right to remove content and suspend or terminate accounts that violate these rules without notice.

8. Data Privacy and Confidentiality

We are committed to protecting your privacy. Our collection and use of personal information are governed by our Privacy Policy.

  • Personal Information: Your personal data, such as your name and email address, will be kept confidential and will not be sold or shared with unaffiliated third parties without your consent, except as required by law or as described in our Privacy Policy.
  • Writer Application Data: Information submitted through the "Become a Writer" application form, including your motivation and writing samples, is considered strictly confidential. This information will be used exclusively for the internal evaluation of your application by the Wild Fantasy Writers team and will not be shared publicly or with any unauthorized third parties.

9. Age Restrictions

  • Users must be at least 8 years old to create an account and read content.
  • Users must be at least 15 years old to become an author and submit content.

10. Limitation of Liability

The Platform is provided “as is” and “as available.” Wild Fantasy Writers and Josue A. Burkhan do not guarantee that the service will be uninterrupted or error-free. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, including data loss, arising from your use of the service.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our website or by sending an email. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

12. Dispute Resolution

You agree that any dispute or claim arising from or relating to these Terms will be resolved by binding arbitration, rather than in court. The arbitration will be conducted by a neutral arbitrator and will be administered under the rules of an established international arbitration association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.
